IS A TRIBAL TRUST?
As a tribal government, you have benefits you want to give to community
members. Historically, trusts have been used to hold those
benefits and give them under proper conditions.
What is a trust? It is a legal entity created by the tribal
government, or individual tribal members, that holds money for the
benefit of someone in the future. Normally, the creator will no
longer be in control of how the money is given, and the trustee of the
trust will be in control. However, the trustee is bound by special
laws requiring it to follow detailed instructions from the creator of
the trust.
Traditionally, trusts are used by families to give money to children and
grandchildren for special purposes, such as education or housing, or to
give money over time rather than all at once. A government may
follow the same pattern with respect to benefits for its community
members.
